Procurement
ADIF-Alta Velocidad (ADIF-High Speed) applies the general contracting principles provided for in the current legislation, given its nature as a public business entity within the Ministry of Transport, Mobility and Urban Agenda.
ADIF-Alta Velocidad's policy aims to optimize the relationship between cost, quality and benefits in all kinds of goods and services contracts, and to guarantee the principles of disclosure, competition, transparency, equality and non-discrimination.
1. Legal regime applicable to ADIF-Alta Velocidad's contracts
With the entry into force of Law 9/2017 of 8 November on Public Sector Contracts and in application of the provisions of its Article 3, Adif - Alta Velocidad (Adif - High Speed) holds the consideration of Contracting Authority, not Public Administration. In addition, Aidf - Alta Velocidad operates within the scope of Royal Decree-Law 3/2020 of 4 February on contracting procedures in water, energy, transport and postal services sectors.
Based on the foregoing, in accordance with points 2 and 3 of Additional Provision 8 of Law 9/2017 and in general, the award of Adif - Alta Velocidad (Adif - High Speed) contracts intended for any of the activities listed in the scope of application of current legislation on procurement procedures in water, energy, transport and postal services sectors, shall be governed by said legislation (Royal Decree-Law 3/2020).
Contracts excluded from the application of current legislation on procurement procedures in water, energy, transport and postal services sectors conducted by Adif - Alta Velocidad shall be governed by the relevant provisions of the aforementioned Law 9/2017 (Articles 318 to 320).
