Personal data protection

Data protection rights may only be exercised by the following:

• Data subjects themselves, as data protection is an individual right, who shall always provide proof of their identity.
• Legal representatives acting on behalf of data subjects who are incapacitated or minors, and therefore unable to exercise their rights themselves. Legal representatives shall provide proof of their capacity.Personal data shall not be disclosed to third parties who do not provide documentary evidence of the data subject's incapacity or minority and of their own capacity as the data subject's legal representative. 
• Voluntary representatives,who shall provide clear proof of the identity of the person represented, by supplying a copy of their national identity document or of an equivalent document, and of the proxy conferred by said person.

Data subjects may exercise their rights by submitting a request to the Data Controller.The request to exercise their rights of access, rectification, erasure, objection and restriction shall be addressed to the corresponding department or office, stated in the various legal notices or privacy and data protection policies which inform data subjects of the aspects covered in Article 13 of the GDPR.The request shall be managed centrally at the address indicated here below.Likewise, data subjects who ask any ADIF members of staff about how to exercise their rights or raise the need to do so, shall be referred to said address. The request shall contain the following information and/or documents:

• Data subject's full name.
• Photocopy of their national identity document or alternative document that provides proof of their identity.
• Photocopy of the national identity document of the person representing an incapacitated data subject, where proxy has been conferred, and of the document providing proof of said proxy.
• Specific request or right exercised.
• Address for receiving notifications.
• Date and signature.
• Documents supporting the request formulated, if applicable.
• Intended method or system for accessing personal data.
• Requests to access, rectify, erase, restrict or object to the processing of personal data referring to images of identified or identifiable natural persons shall contain a recent photograph of the data subject.
• Requests to exercise the right of erasure shall specify whether it is a question of erasing incorrect or inaccurate data or of withdrawing consent previously given to collect and process the data.

Any personal data provided will be processed by ADIF - Alta Velocidad (ADIF - High Speed) in order to enable access to the services offered through the website www.adifaltavelocidad.es.
Your data will be kept for the period of time that is strictly necessary to fulfill the aforementioned purposes.Thereafter, your data will stay blocked and only accessed to determine any responsibilities deriving from this purpose and from the processing of said personal data.

The legal basis for processing your personal data is the exercise of public powers conferred on the data controller in accordance with the Common Administrative Procedure of Public Administrations Act (Law 39/2015 of 1 October).

Your data will not be disclosed to any third parties, except for legal obligations.

In accordance with the current legislation, as the owner of your personal data, you have the right to:

• Confirm whether ADIF - Alta Velocidad (ADIF - High Speed) is processing personal data that concern you, and access the data and any information related to its processing (right of access).
• Request the rectification of inaccurate data (right to rectification).
• Request the erasure of your data –for example, if they are no longer necessary for the purpose for which they were collected– in which case ADIF - Alta Velocidad (ADIF - High Speed) will cease to process them, except for the exercise or defence of legal claims (right to erasure).
• Request the restriction of the processing of your data, in which case they may only be processed with your consent, except for the exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a member State (right to restriction of processing).
• Object to the processing of your data, in which case ADIF - Alta Velocidad (ADIF - High Speed) will cease to process them, except for the defence of legal claims (right to object).
• Withdraw your consent for the purpose indicated in the section "What is the purpose of processing your personal data?". This will not impact the legality of the processing based on your consent prior to its withdrawal (right to withdraw consent).
